Notice periods for indefinite employment
- More than 2 weeks to 6 months: 1 week
- More than 6 months to 2 years: 2 weeks
- More than 2 years to 5 years: 4 weeks
- More than 5 years: 8 weeks
What can form part of final pay?
The Labour Department notes that termination benefits may include notice pay, vacation pay, outstanding wages, and severance pay. Eligibility and calculation depend on the reason employment ends, length of service, contract type, and other facts.
Severance basics
For qualifying workers with five to ten years of continuous employment, section 183 provides one week’s wages for each complete year of service in the circumstances set out there. Different rules apply over ten years, including the historical pre-May-2011 split.
