Belize Termination, Severance & Final Pay Guide

Statutory notice periods

For indefinite employment, the Labour Act sets notice periods based on continuous service: one week after more than two weeks and up to six months; two weeks after more than six months and up to two years; four weeks after more than two years and up to five years; and eight weeks after more than five years.

The Act also permits the employer to pay the wages, remuneration, and benefits that would have been due during the notice period instead of requiring the employee to work the notice.

What can form part of final pay?

The Labour Department identifies termination benefits that may include notice pay, vacation pay, outstanding wages, and severance pay. Which items are due depends on the facts and the applicable Labour Act provisions.

Severance basics

For five to ten years of continuous employment, qualifying severance is one week’s wages for each complete year of service in the circumstances described by section 183.

For service over ten years, qualifying severance is generally two weeks’ wages for each complete year after May 1, 2011, with a different historical rate for service before that date. A worker with at least ten years of continuous service who resigns can qualify for a gratuity computed under the severance rules.

Why final-pay calculations need review

  • Fixed-term contracts can require different treatment from indefinite contracts.
  • Collective agreements or contracts can provide better terms.
